Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the website fleet.gasolinamovil.com and the Gasolina Móvil Fleet mobile application (together, or individually, the "Service") managed and operated by Artisoft Laboratories LLC. ("we", "us" or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms, which apply to all visitors, users and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part, you do not have permission to access the Service.

Purchases

Gasolina Móvil Fleet offers prepaid and corporate postpaid payment options, subject to credit approval. Fuel purchases can be authorized through the mobile app (code scanning) or using physical fleet cards issued by the Company.

You are responsible for maintaining sufficient funds in your prepaid account or paying postpaid invoices on time to avoid suspension of the Service.

We reserve the right to refuse or cancel your order at any time for reasons including, but not limited to: product or service availability, errors in the description or price, an error in your order, or other reasons, or if fraud or an unauthorized or illegal transaction is suspected.

Availability, Errors and Inaccuracies

We are constantly updating product and service offerings. We may experience delays in updating information on the Service and in our advertising on other websites.

The information on the Service may contain errors or inaccuracies and may not be complete or current. Products or services may be mispriced, incorrectly described, or unavailable, and we cannot guarantee the accuracy or completeness of the information. We therefore reserve the right to change or update information and to correct errors at any time without prior notice.

Contests, Sweepstakes and Promotions

Any promotions available through the Service may be governed by rules separate from these Terms. If you participate, review the applicable rules and our Privacy Policy. If a promotion's rules conflict with these Terms, the promotion's rules will apply.

Accounts

The Service allows the creation of Fleet Administrator accounts and authorized Driver profiles.

The Fleet Administrator is solely legally and financially responsible for all transactions, fuel purchases and activities carried out by Drivers under their account, whether through the mobile app (Fleet ID/QR) or physical cards linked to the account.

The Administrator is responsible for revoking access or blocking cards of inactive employees. We reserve the right to refuse service, cancel accounts, remove or edit content, or cancel orders at our sole discretion.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of the Company and its licensors. The Service is protected by copyright, trademark and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by Artisoft Laboratories LLC. We have no control over, and assume no responsibility for, the content, privacy policies or practices of such third parties, and we do not guarantee their offerings.

You acknowledge and agree that Artisoft Laboratories LLC will not be responsible, directly or indirectly, for any damage or loss caused or alleged to be caused by the use of or reliance on such content, goods or services. We strongly recommend reading the terms and privacy policies of any third-party site you visit.

App Use and Security Validations

To prevent fraud and authorize fuel transactions, Gasolina Móvil Fleet may require access to your mobile device's camera. By using the Service, the user (driver) consents to capturing and transmitting photographs of the vehicle's license plate and odometer.

The Fleet Administrator acknowledges and agrees that this photographic information will be stored and used exclusively for transaction verification and account audit purposes.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason, including breach of the Terms. If you wish to close your account, you may simply stop using the Service. Provisions that by their nature should survive termination will remain in effect.

Indemnification

You agree to defend, indemnify and hold harmless the Company and its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any claims, damages, obligations, losses, liabilities, costs or expenses (including attorneys' fees) resulting from: (a) your use of and access to the Service, by you or anyone using your account and password; or (b) a breach of these Terms.

Limitation of Liability

In no event shall Artisoft Laboratories LLC, nor its directors, employees, partners, agents, suppliers or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, use, goodwill or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the Service; (ii) any conduct or content of a third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

Although the Service provides management tools, such as affiliated-station restriction and real-time transaction monitoring, the Company will not be liable for misuse of fleet funds, internal fraud committed by the Administrator's employees or drivers, or unauthorized transactions resulting from the Administrator's negligence in managing the account or protecting its Fleet IDs and physical cards.

Disclaimer

Your use of the Service is at your own risk. The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied. We do not warrant that: (a) the Service will function uninterrupted, secure or available at any particular time or place; (b) errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for indirect or incidental damages, so the above limitations may not apply to you.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict-of-law provisions. Our failure to enforce any right or provision will not be considered a waiver of those rights. If any provision is held invalid or unenforceable, the remaining provisions will remain in effect. These Terms constitute the entire agreement between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days' notice before the new terms take effect. By continuing to access or use the Service after revisions take effect, you agree to the revised terms.
